PREAMBLE

These General Terms and Conditions of Sale (hereinafter "T&Cs") exclusively govern the contractual relationship between: Mr Nicolas DE CHENERILLES, sole trader (Entrepreneur Individuel), trading under the name OÈST, registered with the Répertoire National des Entreprises (RNE) under SIREN 848 746 335, whose registered office is at 3 rue des Souquayrots, 40230 Saint-Vincent-de-Tyrosse (hereinafter "the Seller"). And any consumer making a purchase through the website oest-ateliers.fr (hereinafter "the Customer").

ARTICLE 1: SCOPE AND ENFORCEABILITY

These T&Cs apply without restriction or reservation to all sales concluded by the Seller with non-professional buyers. The Customer declares having read and accepted these T&Cs by ticking the box provided for this purpose before confirming the online order. These T&Cs prevail over any other document.

ARTICLE 2: PRODUCT CHARACTERISTICS

The products offered for sale are those shown on the website on the day the Customer consults it.

Nature of the products: Lights (pendants, floor lamps, table lamps), bags and accessories made from recycled technical sails.

Unique character (upcycling): The Customer is expressly informed that the products come from upcycling. As they are made from materials that have already sailed (sails), each piece is unique. Variations in texture, colour, stitching or slight signs of wear linked to the sail’s previous life cannot be considered defects, but are the very essence of the OÈST handcrafted product.

Materials: The structures of the ceiling lights are made of steel. The floor lamps and bedside lamps include elements in eco-responsible French wood.

Availability: Offers are valid while stocks last.

ARTICLE 3: PRICES

Prices are expressed in Euros (€) including all taxes. As a sole trader, VAT is applied according to the scheme in force on the day of the order.

The prices shown on the product pages do not include delivery costs.

Shipping costs are calculated and displayed before the final confirmation of the order.

ARTICLE 4: ORDERS

The Customer confirms the order after checking the basket and accepting the T&Cs. The sale is firm and final after:

The sending of a confirmation email by the Seller.

The collection of the full price. The Seller reserves the right to suspend any order in the event of an existing payment dispute with the Customer.

ARTICLE 5: PAYMENT TERMS

Payment is due immediately on the day of the order.

Means of payment: Bank cards via a secure platform.

Security: Transactions are encrypted (SSL/TLS) and secured by our payment providers. The Seller never has access to the Customer’s bank details.

ARTICLE 6: DELIVERY AND SHIPPING

Area: Mainland France and the areas offered during checkout.

Shipping times: The Seller endeavours to ship products within 2 working days of order confirmation.

Delay: If a delay exceeds 7 working days after the planned shipping date (except in cases of force majeure), the Customer may request cancellation of the sale and obtain a full refund within 14 days.

ARTICLE 7: TRANSFER OF OWNERSHIP AND RISK

Retention of title: Products remain the property of the Seller until full payment of the price.

Transfer of risk: The risk of loss or damage to the products passes to the Customer when the Customer (or a third party designated by the Customer) takes physical possession of the parcel.

ARTICLE 8: RECEIPT AND RESERVATIONS (TRANSPORT DAMAGE)

The Customer must check the condition of the parcel in front of the carrier.

In case of an anomaly: The Customer must refuse the parcel or write precise, dated reservations on the delivery note.

Reporting: The Customer must inform the Seller by email at contact@oest-ateliers.fr within 48 hours of receipt to allow a claim against the carrier.

ARTICLE 9: RIGHT OF WITHDRAWAL AND RETURNS

9.1. Legal period: The Customer has a period of fourteen (14) clear days from receipt to exercise the right of withdrawal without having to give reasons.

9.2. RETURN COSTS: In accordance with the regulations, RETURN COSTS ARE BORNE SOLELY BY THE CUSTOMER.

9.3. Condition of the product: The product must be returned in its original packaging, in perfect condition for resale. Any damaged, soiled or incomplete product will not be refunded.

9.4. Exception (personalised products): The right of withdrawal does not apply to products made to the Customer’s precise specifications (made-to-measure orders outside the standard catalogue).

ARTICLE 10: LEGAL GUARANTEES

The Seller is liable for lack of conformity of the goods with the contract under the conditions of Article L.217-4 et seq. of the French Consumer Code, and for hidden defects of the goods sold under the conditions of Articles 1641 et seq. of the French Civil Code.

Conformity: The Customer has two years from delivery of the goods to take action. The Customer may choose between repair or replacement of the goods, subject to the costs provided for by Article L.217-9 of the French Consumer Code.

Hidden defects: The Customer may decide to implement the guarantee against hidden defects of the goods sold. The Customer may then choose between cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.

Specific reminder: Given the "upcycled" nature of OÈST products, the marks of the sails' life (patina, creases, original stitching) do not constitute a lack of conformity.

ARTICLE 11: LIMITATION OF LIABILITY

The Seller cannot be held liable in the following cases:

Failure to comply with the legislation of the country to which the products are delivered (outside France).

Misuse, professional use, negligence or lack of maintenance by the Customer.

Damage resulting from non-compliant installation of the lights by the Customer or an unqualified third party.

ARTICLE 12: INTELLECTUAL PROPERTY

All elements of the oest-ateliers.fr website (texts, logos, visuals, product designs) are protected by copyright and intellectual property law. Any total or partial reproduction of the creations of Nicolas DE CHENERILLES is strictly prohibited and may constitute an offence of counterfeiting.

ARTICLE 13: DATA PROTECTION (GDPR)

The personal data collected is necessary for order management and invoicing. It may be passed on to logistics (delivery) and payment providers. The Customer has a right of access, rectification and erasure of their data via the address: contact@oest-ateliers.fr.

ARTICLE 14: SEVERABILITY (SAVING CLAUSE)

If any provision of these T&Cs is found to be void, illegal or unenforceable under a rule of law in force or a final court decision, it shall be deemed unwritten. Such nullity shall in no case entail the nullity of the contract, nor affect the validity of the other provisions, which shall retain their full force and scope.

ARTICLE 15: FORCE MAJEURE

Performance of the Seller’s obligations shall be suspended in the event of a fortuitous event or force majeure (fire, flood, total strike of carriers, pandemic blocking the supply chain) preventing their performance. The Seller shall inform the Customer by any means as soon as possible.

ARTICLE 16: MEDIATION AND DISPUTES

16.1. Prior complaint: In the event of a dispute, the Customer must first contact OÈST customer service on +33 6 14 80 07 16 or by email.

16.2. Mediator: Failing an amicable solution, the consumer Customer may use a certified consumer mediator free of charge. In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, we will provide the details of the chosen mediator on request.

ARTICLE 17: APPLICABLE LAW AND JURISDICTION

These T&Cs are governed by French law. Any dispute relating to their interpretation and/or performance falls within the jurisdiction of the French courts. In the event of a dispute with a professional customer, exclusive jurisdiction is given to the courts of Dax.
